Passengers in Road Traffic Accidents

Passenger Claims and Road Traffic Accidents

Passenger Claims and
Road Traffic Accidents

Unfortunately, passengers in vehicles are often caught up in road traffic accidents through absolutely no fault of their own. If you are a passenger who has been involved in a road traffic accident and the road traffic accident happened within the last three years, then you are legally entitled to claim compensation. However, more often than not, passengers involved in road traffic accident claims can become embroiled in very difficult and protracted legal liability disputes between the insurers of the driver whose vehicle they were a passenger in and the insurers of the other vehicle involved in the accident. This is especially the case when both drivers blame each other for the road traffic accident. Accordingly, to avoid this problem, it is essential that you the passenger are represented by an expert.

The solicitor representing a passenger should be somebody independent who is not also representing the driver whose vehicle the passenger was in or the driver of the other vehicle. If they are not independent, then the passengers claim could potentially be seriously prejudiced. This is where we can help as we ensure that we provide all of our passenger Claimants with independent legal representation and we are scrupulous about ensuring that we do not represent any of the drivers involved in the same accident.

Please note that it is perfectly acceptable for the same solicitor to represent all of the passengers involved in a road traffic accident so long as those passengers were all in the same vehicle. To represent all such passengers does not prejudice the claim of any individual passenger.

By law all drivers must have at least third party insurance cover. This means that their insurers will pick up the bill if the driver causes a road traffic accident and injury to any other party, including any passengers.

If you as a passenger are unfortunate enough to be involved in a road traffic accident with an uninsured driver, or with a driver who doesn't stop after the road traffic accident, then your claim is likely to be covered by a special agreement covered by the Motor Insurers' Bureau (the MIB) which is an organisation set up specifically to cover such road traffic accidents. This includes situations where you are unfortunate enough be a passenger in a vehicle driven by an uninsured driver which becomes involved in a road traffic accident.
